The company operating among the biggest resorts in the surf capital of Baler has been charged with tax code violations for allegedly failing to report “correct and accurate information” to the Bureau of Internal Revenue for almost two years.
The BIR filed charges of violation of the tax code against Sea and Sierra Vista, Inc. (SASVI), SASVI president Pia Bustamante, treasurer Alexandra Angara and finance officer Lailanie Hernandez before the Department of Justice.
In its complaint, the BIR accused SASVI of “wilful attempt to evade or defeat tax for 2013 and 2014, deliberate failure to supply correct and accurate information in the Income Tax Returns (ITR) for 2014 and Value Added Tax (VAT) Returns for the first three quarters of taxable year 2013, and wilful failure to file VAT Returns for the 4th quarter of 2013 and the four quarters of 2014, in violation of Sections 254 and 255 in relation to Sections 253(d) and 256 of the National Internal Revenue Code of 1997, as amended (Tax Code).”
SASVI is registered under the business names Bahia De Baler Garden Resort, Bahia De Baler Business Center, Bahia De Baler Bar and Grill, Costa Pacifica and Beach House; these resort are all in Barangay Sabang, Baler in Aurora.
Barangay Sabang is a popular tourist destination for surfing enthusiasts.
The BIR’s Tax Compliance Verification Drive (TCVD) determined that SASVI was supposedly using unregistered Point-of-Sales Machines and Computerized Accounting System/Books of Accounts without the manual books of accounts.
Its accounting records showed a discrepancy of P21.20 million in its Income Tax Return (ITR) for 2014.
Consequently, SASVI was assessed an estimated aggregate tax liability of P53.28 million, inclusive of surcharges and interests.
Its liability for 2013 is P11.93 million and for 2014 is P41.35 million (Income Tax – P3.02 million; and VAT – P38.33 million).
