THE Bureau of Internal Revenue (BIR) on Thursday said it cannot grant tax exemption to 2015 Miss Universe Pia Wurtzbach.
BIR Commissioner Kim Jacinto-Henares told reporters at the Department of Justice (DOJ) that despite passage of a House of Representatives resolution in favor of Wurtzbach, they still cannot grant the same.
Henares said the House resolution does not carry the force and effect of a law.
She added that she will only honor the law on the basis of the National Internal Revenue Code or the Philippine Tax Law.
“A resolution is not a law. So if you want to exempt somebody, because in the law now there is no exemption. So if you want to exempt somebody, you have to pass a law. A law requires a vote of the House and the Senate,” Henares said.
“You just have to declare it [income], then you compute the Philippine tax, then you show what you paid in the US. Attach it to your ITRs [income tax returns], so we will recognize the payment that you made in the US,” she added.
