THE Court of Appeals (CA) has affirmed its decision reinstating Dr. Teresita Cascolan as Zamboanga City Schools Division Superintendent after finding her guilty of simple misconduct. In its resolution dated December 3, 2014 but was released to the media only recently, the CA’s Sixth Division denied the motion for reconsideration filed by the Department of Education (DepEd) through the Office of the Solicitor General (OSG). The DepEd dismissed Cascolan from service on August 16, 2005 citing her alleged involvement in irregularities and anomalous activities. Cascolan appealed her case before the CA, which slapped her instead with a two-month suspension. It also directed the DepEd to reinstate Cascolan to her position, or its equivalent, without loss of seniority rights, and to pay her backwages and benefits less the amount equivalent to her salary for two months and one day.
