• CA grants BCDA’s petition for review


    The Court of Appeals (CA) has granted the petition for review filed by the Bases Conversion and Development Authority (BCDA) in the case of the Camp John Hay Development Corporation (CJHDC) in Baguio City.

    In a ruling dated Sept. 30, 2014, written by Associate Justice Victoria Paredes and released on Thursday, the CA’s Special 11th Division reversed and set aside the April 27, 2012 ruling of the Baguio City Regional Trial Court (RTC) Branch 6.

    The CA lifted the writ of preliminary injunction issued by the Baguio City RTC to the CJHDC led by Robert John Sobrepena.

    Concurring with the ruling were Associate Justices Isaias P. Dicdican and Agnes Reyes-Carpio.

    Records showed that the CJHDC has not been paying lease rentals to the BCDA since 1998 for a 247-hectare property inside the John Hay Special Economic Zone and its arrears have ballooned to Php3.4 billion, 25 percent of which is for the local government of Baguio City. PNA
