FOR allegedly pocketing P10,000, Mayor Efren Guntrano Gica of Dumanjug town in Cebu was dismissed over serious dishonesty and grave misconduct by the Office of the Ombudsman.
The Ombudsman also ordered the forfeiture of all benefits due to Gica, his perpetual disqualification from public office and cancellation of his civil service eligibilities.
On July 15, 2014 former Mayor Nelson Gamaliel Garcia filed a case against Gica, then vice mayor of Dumanjug alleging that then acting mayor, got a cash advance of P50,000 from the municipal treasurer. The money was to buy meals for barangay (village) officials attending the seminar of the Association of Local Budget Officers in Cebu City in April 2014.
In his liquidation report, Gica stated that the total cost of dinner was P21, 435 and he returned the remaining amount of P28, 565.
However, the Office of the Ombudsman found a discrepancy in Gica’s liquidation report saying that the actual amount spent for the said dinner was only P11,435 and Gica altered the original amount stated in the restaurant’s official receipt.
“The official receipt, while by its nature is a commercial document, acquires the character of a public document when it becomes part of an official record and is certified by a public officer duly authorized by law,” the Ombusman’s order explained.
Meanwhile, Gica’s legal counsel, Edgar Gica, said they will file a motion for reconsideration with temporary restraining order saying that the Ombudman’s decision is not final and executory.
