Comelec junks poll protest


LUCENA CITY: The Commission on Elections (Comelec) First Division has dismissed the protest filed by Quezon gubernatorial candidate Irvin Alcala against incumbent David Suarez, who beat Alcala by more 59,000 votes.
An order dated November 4, 2013 and signed by First Division’s presiding Commissioner Lucenito Tagle stated, “Considering that no Motion for Reconsideration was filed by protestant Irvin Alcala within the prescribed period provided under the 1993 Comelec Rules of Procedures in the above-entitled case, the Order of dismissal issued by the Commission [First Division] dated October 17, 2013 is now final and executor.”

Suarez said he was not surprised by the decision because the protest has no merits primarily because of Alcala’s failure to deposit cash bond as specified by Comelec Resolution 8804.

Alcala was Quezon’s second district representative when he ran and lost against incumbent Gov. David “Jayjay” Suarez in May 2013.
