Court affirms libel raps vs preacher Eli Soriano


THE Court of Appeals (CA) has junked an appeal filed by Ang Dating Daan head Eliseo “Eli” Soriano in connection with libel charges filed against him by another preacher.

In a seven-page resolution penned by Associate Justice Maria Elisa Sempio Diy and concurred in by Associate Justices Ramo Bato, Jr. and Manuel Barrios, the CA’s 12th Division denied Soriano’s motion for reconsideration on September 28, 2015 assailing the August 17, 2015 ruling of the appellate tribunal.

The CA had affirmed the consolidated judgment dated June 8, 2012, rendered by Branch 60, Regional Trial Court of Iriga City (Camarines Sur) in two criminal cases for libel hurled against Soriano by Jesus Miracle Crusade’s preacher Wilde Almeda.

The complaint alleged that Soriano uttered malicious or libelous comments and accusations over the radio on the preaching made by Almeda in Iriga City and Baao, Camarines Sur.

The lower court rendered its ruling against Soriano, prompting him to seek redress with the CA, which previously turned down his plea.

In its new ruling rendered last May 18, 2016 but was released only recently, the CA denied Soriano’s motion.

“We rule that the instant motion cannot prosper on said grounds as the same were mere reiterations of the arguments which were already contained in the various pleadings submitted before the court and were already considered in arriving at our decision dated August 17, 2015,” the court held.

“This court already made an exhaustive discussion regarding the presence of all the elements of the crime of libel defined under Article 353 of the Revised Penal Code.”

“As such, any further discussion on the matter would only be superfluous and redundant,” it said.
