The death penalty is not a cruel and unusual punishment. The Constitution allows1 Congress to determine when to enact a capital punishment law (Art. 3 Sec. 19(1) 1987 Constitution). And capital punishment is not always cruel and unusual. Such cruel punishment must not be merely a snapping out of a life. It implies something inhuman and barbarous, something more than the mere extinguishment of life (People v. Echegaray, Feb. 7, 1997).
