Justice Secretary Leila De Lima on Thursday ordered the National Bureau of Investigation (NBI) to prepare a copy of the hard drive of Benhur Luy, the prime whistleblower in the pork barrel scam.
De Lima issued the directive after the Senate Blue Ribbon Committee issued Thursday a subpoena to the Department of Justice (DOJ) and the NBI for them to submit the copy of the digital files of Luy.
Atty. Raji Mendoza, legal counsel of Luy, earlier wrote the Senate and informed them that the original hard drive of Luy is in the custody of the NBI Cybercrime Division where it underwent a forensic examination to preserve the integrity of its digital record.
According to De Lima, they have to comply with the subpoena issued by the Senate.
Nonetheless, De Lima said, the DOJ will still consult the Office of the Ombudsman to ask its opinion on the subpoena of the Senate.
De Lima added that the hard drive of Luy is one of the basis of the NBI and the Field Investigation Office of the Office of the Ombudsman in its fact-finding investigation into the Priority Development Assistance Fund (PDAF) scam.
Meanwhile, De Lima is set to ask for another extension for the submission of the extended affidavit of Janet Lim Napoles after she was informed by Napoles lawyer that they cannot submit her sworn affidavit Thursday.
De Lima said they will ask the Senate for an extension of until Monday next week to submit the complete affidavit of Napoles. PNA
