The Office of the Ombudsman has filed graft charges against former Binmaley, Pangasinan Mayor Lorenzo Cerezo over the alleged anomalous lease contracts amounting to P2 million.
Cerezo is charged before the Sandiganbayan for 21 counts of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act, along with Edwin Castillo who was the proprietor and owner of MTAC Merchandising which entered into a contract with the local government unit.
The Ombudsman said that Cerezo approved 21 contracts from November 2011 to April 2013 covering the lease of dump trucks, backhoes, pay loaders and cement mixers from MTAC allegedly without the necessary public bidding.
“Without public bidding, the government was deprived of the best possible price for the lease of heavy construction equipment,” the Resolution said.
Section 3(e) of the anti-graft law prohibits public officials from causing any undue injury to any party, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence.
