The Office of the Ombudsman found sufficient grounds to file graft and malversation charges against former Mayor Arfran Quiñones of Davao Oriental in connection with alleged misappropriation of government properties amounting to P446,425.77.
In a statement issued on Tuesday, the Ombudsman said that it found that government properties under Quiñones’ custody remained unaccounted for after his term had ended.
The properties included technical and scientific equipment, a laptop, IT equipment and software, office supplies, mobile phone, and a projector.
Under Section 3(e) of the Anti-Graft and Corrupt Practices Act, public officials are prohibited from causing undue injury to any party, or giving any private party unwarranted benefits, advantage or preference in the discharge of their official functions through manifest partiality, evident bad faith or gross inexcusable negligence.
Meanwhile, malversation is committed by any public officer accountable for public funds or property who shall appropriate the same, or shall take or misappropriate or shall consent, or through abandonment or negligence, shall permit any other person to take such public funds or property.
