THE Ombudsman has found probable cause to file graft and malversation charges against the former manager of Cantilan Water District (CWD) in Surigao del Sur in connection with the P1.32 million unliquidated cash advances.
In filing the case before the Sandiganbayan, the Ombudsman said former CWD general manager Segundino Buniel has failed to liquidate the amount accumulated over a period of eight years.
“The case stemmed from a complaint filed by the Commission on Audit (COA)-Surigao del Sur after Buniel failed to settle his cash advances despite demands in June 2011 and November 2012,” it said in a statement issued on Thursday.
Buniel requested COA for an additional 30 days to completely liquidate the funds and that payment be made through salary deductions.
Ombudsman Conchita Carpio-Morales said in the Resolution, “(R)espondent has the bounden duty to settle his cash advances. His failure to act in a situation where there is a duty to act demonstrates gross inexcusable negligence, hence, he should be made to answer for this charge.”
The ruling stressed that Buniel is an accountable officer as the CWD’s General Manager and it was incumbent upon him to liquidate every cash advance as soon as the funds have served their purpose.
Last May, Morales dismissed Buniel from the service after finding him administratively liable over the said unliquidated cash advances.
