Ex-Tuguegarao official charged over cash advance


The Office of the Ombudsman has filed a case before the Sandiganbayan against former Tuguegarao City (Cagayan) Vice Mayor Danilo Baccay over his alleged failure to account for a cash advance of P400,000 within the prescribed period in 2009.

Assistant Special Prosecutor I Gregorio Marco dela Torre of the Ombudsman accused the respondent of violation of Article 218 of the Revised Penal Code.

Based on the charge sheet, Baccay received the cash advance, which was meant for the codification of the city’s ordinances, “and, as such, accused Baccay had the control and custody of the said amount of P400,000.00 representing the cash advance, which he is required by law to render an account within the prescribed period as provided under Commission on Audit Circular No. 97-002, dated February 10, 1997, in relation to Section 340, Republic Act 7160, the Local Government Code…”

Baccay, however, allegedly “fail[ed]to render an account within the prescribed period.”
The Ombudsman recommended a P6,000-bail for his provisional liberty.
