The Supreme Court en banc has confirmed the stay order earlier issued by Chief Justice Lourdes Sereno stopping the Commission on Elections from disqualifying Senator Grace Poe from the presidential race.
It was Sereno who issued the temporary restraining order because the high court was on recess.
According to unimpeachable sources of The Manila Times in the high court, an overwhelming majority of the justices confirmed the (TRO) issued by Sereno on December 28, 2015.
The voting was 12- 3, the source said.
The issuance of the TRO means that the Comelec will have to include the name of Poe in the official ballot even if the tribunal has yet to discuss the merits of the case.
The Comelec en banc disqualified Poe because she is not a natural-born Filipino and she failed to meet the residency requirement imposed by law on presidential candidates.
