Ilagan City Mayor Jose Marie Diaz of Isabela province has filed perjury and malicious prosecution charges before the Quezon City Prosecutor’s Office against a woman who filed a graft complaint against him before the Office of the Ombudsman.
Named as respondent in the complaint was Maria Nympha Mandagan of Unit F, Corinthian Townhomes, No. 6 Ilang-Ilang Street Rosarion Heights, Quezon City.
In his seven-page complaint affidavit, Diaz said that on Nov. 26, 2014, Mandagan executed a graft complaint against him before the Ombudsman in connection with the construction, rehabilitation, and/or upgrading of the Alibagu Barangay Health Station at Ilagan City in Isabela.
In her complaint, Mandagan alleged that the mayor approved a resolution passed by the city council for the implementation of said project that caused the release of government funds directly to SMT Construction and pocketed the capital outlay intended for the paurchase of a lot for the barangay hall and health center.
Mandagan further accused Diaz of land grabbing a portion of the parcel of land she inherited from her late father for the construction of the two structures as well as a waiting shed.
However, the mayor, in his complaint, said the respondent made a deliberate and willful assertion of falsehoods since all her allegations are lies.
Diaz denied approving a resolution and said that the city council has not approved such measure intended for the said project.
He further denied all the allegations of Mandagan in her complaint filed before the Ombudsman, adding that it was not the Ilagan City government who implemented the project but the Department of Health (DOH) Region 2.
