Protagonists over the preventive suspension of Makati City Mayor Jejomar Erwin “Junjun” Binay Jr. are slated to face off at the Court of Appeals (CA) on Monday and Tuesday over supposed defiance by Malacanang allies of a temporary restraining order (TRO) against the suspension.
Interior Secretary Manuel Roxas 2nd, Justice Secretary Leila de Lima and Ombudsman Conchita Carpio-Morales had demanded lifting of the TRO, which was issued by the CA 6th Division.
They said the TRO is moot and academic, since Makati Vice Mayor Romulo Pena has been sworn in as acting city mayor.
The Binay camp has asked that Roxas, de Lima and Morales be cited for contempt, a move that prompted Morales to elevate the case before the Supreme Court (SC).
But the SC refused to stop the CA from implementing the TRO.
The Senate blue ribbon committee had ordered an inquiry into transactions and assets of Binay on the basis of the testimonies of Mercado,. Renato Bondal and Nicolas Enciso VI.
