More than a decade ago, GMA did not like any Judicial and Bar Council nominee for Presiding Justice of the Court of Appeals for having perceived links to the opposition. She asked the JBC for a new list. Quite incredibly, the JBC meekly complied, and not for the last time, either.
It could have asked GMA who it was she wanted to save time and effort.
The JBC is reported today to stand its ground on its nominees for a new Sandiganbayan Justice. Way to go.
PNoy should just pick a nominee and need not be bothered by the 90-day deadline, which I submit, is only directory, not mandatory. A little de minimis delay causes no substantive harm.
Just do it. A Justice would know when to inhibit or recuse oneself, motu proprio, or on motion by a party.
