Judge Reynaldo Alhambra, First Vice Executive and Branch 53 Judge of Manila Regional Trial Court, has issued a 72-hour temporary restraining order (TRO) on the removal of retired Court of Appeals Justice Artemio Tuquero as president of Pamantasan ng Lungsod ng Maynila (PLM).
The order was signed on Thursday but it was released to the media only on Friday.
The hearing on the TRO is set for July 21 at 10 a.m.
The case stemmed from the PLM board of regents’ resolution dated July 8, 2014 temporarily appointing Amado Valdez as the school’s acting president.
Manila Mayor Joseph Ejercito Estrada, in his capacity as chairman of the PLM board of visitors, on July 9 issued a letter recognizing Valdez as the acting president.
Tuquero, in his petition, said the special board meeting, as well as the resolution appointing Valdez as acting president, were both null and void.
He was appointed president, through a board resolution, on July 3 last year.
The former CA justice said his removal was done with haste, depriving him of any remedy within the university to which he is lawfully entitled.
Section 4 of Republic Act 4196, the PLM charter, states that the mayor of Manila has the sole authority to appoint the university president.
