• Mere harassment case


    We write on behalf of our client, Ms. Mary Jane Lim-Yu, regarding the article, “Brandy heirs battle over $320,000 investment” by Mr. Ritchie A. Horario, which appeared in the 6 December 2013 issue of your esteemed newspaper.

    Our client vehemently denies the charges estafa and qualified theft leveled against her by her own brother, Mr. Prudencio Lim Jr. On the contrary, Mr. Lim Jr. was fully aware that the $320,000 was the retirement benefit intended for their then ailing father, Mr. Prudencio Lim Sr. The latter founded La Fuerza, Inc. and eventually retired as Chairman of the company in 2007.

    The criminal complaint filed by Mr. Lim Jr. before the Makati City Prosecutor’s Office is a mere harassment. The case is his retaliatory maneuver because on 22 October 2013 he was removed as President by a majority of the directors of La Fuerza Inc., which removal was eventually confirmed by at least 83 percent of the company’s record stockholders. When Mr. Lim Jr. was ousted, our client owned the largest block of shares in the said company. Mr. Lim Jr. then attempted but failed to secure a Temporary Restraining Order from the Makati City Regional Trial Court branch 149 (Intra Corp. Case No. 13-1227 entitled “Prudencio Lim, Jr. vs. Arlene Philips”) to prevent his expulsion as President. The intra-corporate case remains pending to date with still no relief being accorded to Mr. Lim Jr.

    Incidentally, Mr. Lim Sr. passed away last 29 November 2013 at the age of 82. By instituting the complaint (on 2 December 2013) a couple of days after their father’s death, Mr. Lim Jr. has shown clear and evident bad faith as the wake for their father was still being held at the time. Apparently, he did not even have the decency to at least wait for the burial before initiating a baseless and malicious criminal case against his older grieving sister.
