THE recent Supreme Court ruling holding Mercury Drug
liable for the injuries sustained by a motorist due to the reckless
driving of the drug retailer’s employee sends the right signal to
companies as to the extent of their responsibility over the conduct
of workers while on the job.
In the said ruling, the High
Court found that the company failed to exercise due diligence in the
supervision of its delivery truck driver, who had been performing
his job even without a license. The said company driver figured in a
vehicular collision that paralyzed for life the driver of the other
vehicle. The company driver was performing his duties on the
strength of a traffic violation receipt, as his license had been
confiscated for an earlier offense, not surprisingly, reckless
driving.
