DISQUALIFIED senatorial candidate
Joselito “Peter” Cayetano lost his appeal to the Supreme Court
to reverse the Commission on Elections’ ruling disqualifying him
from the senatorial race and allowing “Cayetano” votes to go to
Senator-elect Alan Peter Cayetano.
En banc, the High Court ruled to
junk Joselito Cayetano’s petition for certiorari for failure to
comply with the requirements mandated by the Rules of Court.
It said Cayetano’s petition was
insufficient or defective under Rule 7, Section 4 of the Rules of
Court. The ruling was promulgated on June 15.
The Court also saw a failure to
cite important dates.
“Failure to state material
dates showing when notice of judgment, final order or resolution
subject of the petition was received, when a motion for
reconsideration, if any, was filed, and when notice of the denial
thereof was received, to show that petition was filed on time
pursuant to Rule 64, Section 5 in relation to Rule 46, Section of
the 1997 Rules on Civil Procedure,” the ruling says.
Joselito Cayetano alleged that
the Comelec committed grave abuse of discretion when it declared him
a nuisance candidate in the May 14 senatorial polls.
Joselito argued that there was no
truth to the allegations of Alan Peter Cayetano, the Genuine
Opposition senatorial candidate, that he could not launch a
nationwide campaign. He claimed that he could, being a member
of the Kilusang Bagong Lipunan, the party of the late president
and martial law dictator Ferdinand Marcos.
He even mocked Alan Peter for
being afraid of him because he (Joselito) was a big threat to his
(Alan’s) candidacy.
