THE Department of Justice (DOJ) said Tuesday that the
“callboy” who inserted the perfume canister in the rectum of a
homosexual patient who was videotaped while being operated at a Cebu
hospital is also criminally liable.
“He [call boy] can be charged
with mutilation among other cases as stipulated in pertinent
sections of the Revised Penal code involving physical abuse,”
Justice Secretary Raul Gonzalez told reporters.
The controversial incident, which
has been dubbed as “Cebu scandal,” could be seen on the
Internet, through YouTube, prompting the Department of Health and
Congress to conduct an investigation.
Criminal and administrative
charges have been filed against the doctors and as well as the
nurses who operated on the patient.
But Gonzalez said the decision to
file charges against the callboy rests with the patient.
“He [patient] could surface
anew and identify the culprit to the authorities to effect an arrest
and corresponding charges could be filed,” Gonzalez said.
