ILAGAN, Isabela: A regional trial court in Cauayan
City issued an order of garnishment to the branch managers of two
government-owned banks covering around P6.2-million deposits of the
provincial government of Isabela. The banks were ordered not to turn
over the amount except to an authorized sheriff.
The said notice of
garnishment in the amount of P6.189 million issued by Regional Trial
Court Branch 19 in Cauayan City to the branch managers of the
Philippine National Bank and Land Bank of the Philippines was in
compliance to an earlier writ of execution by RTC Judge Raul Babaran
against Gov. Grace Padaca and provincial treasurer Ma. Theresa
Flores under Special Civil Action No. 19-451.
In the said writ of
execution dated January 30, the court ordered provincial sheriff
Jose Martin of the office of the clerk of court to collect from the
provincial government its unpaid balance to RCC Construction
represented by Carmelita Latonio, the contractor of a completed
district hospital in Cauayan City five years ago.
The court further ordered
the provincial government to respond to the note of garnishment
within five days or else the bank would be examined under oath under
Section 37 of Rule 39 of the Rules of Court.
The court ordered Martin to
collect the said amount representing the balance payment of the
provincial government to the contractor in full and in two
separate envelopes.
The said amount subject to
garnishment represented the balance payment of the provincial
government to RCC Construction for the putting up of the Cauayan
District Hospital, whose construction, and those of three others
questioned, was started and completed during the last months of the
previous provincial administration under former Gov. Faustino Dy Jr.
The Isabela provincial government
refused to comment on the matter, saying this was a legal
issue.
