The Energy Regulatory Commission said no power company is found to
be in violation of the market cap set for generating capacity.
In a resolution, the regulatory body said the
generating companies have kept within their market share limitations
in the Luzon, Visayas and Mindanao grids and in the national grid as
a whole for 2008.
To promote competition in the power sector, the
Electric Power Industry Reform Act of 2001 mandates that no company
or related group can own, operate or control more than 30 percent of
the installed generating capacity of a grid and 25 percent of the
national installed generating capacity.
The market share limitation is set by the ERC
every 15th day of March or as often as it may deem necessary.
For this year, the ERC has set the market share
limitation in the Luzon grid at 3,018,271.20 kilowatts; in the
Visayas grid at 491,181.12 kilowatts; and in the Mindanao grid at
511,004.40 kilowatts. For the entire grid, the commission has pegged
an ownership cap of 3,350,380.60 kilowatts.
The figures are lower than the cap set 2007.
