Executive privilege upheld

Court votes 9-6 against Senate

Officials of the executive branch can invoke their right to “executive privilege” in refusing to appear before congressional inquiries, even under pain of arrest.

The Supreme Court en banc, by a 9-6 vote, ruled so on Thursday.

The ruling junked a Senate motion seeking reversal of the High Tribunal’s earlier decision granting a petition of Chairman Romulo Neri of the Social Security System to defend himself with “executive privilege” from accusations of wrongdoing in a canceled national broadband deal.
