Smith may end up in US

Sec. Gonzalez blames SC’s vague phrasing

Even with a Supreme Court ruling that ordered the transfer of US Marine Lance Corporal Daniel Smith from the American Embassy to a Philippine jail, the convicted rapist may still end up serving time abroad or in the United States, according to Justice Secretary Raul Gonzalez.

In his four-page “Brief Resource Paper” that was made public late Wednesday, Gonzalez explained that the possibility existed because of the “vague” phrases in the Supreme Court decision, specifically over the detention of prisoners as provided in Section 10, Article V, of the Visiting Forces Agreement (VFA).
