PROMINENT cosmetic surgeon Dr. Vicky Belo on Monday named
businessman Erick Chua as the one responsible for the unauthorized
copy and distribution of the sex video of Dr. Hayden Kho with
prominent actresses and models.
In the counter affidavit she submitted before
the Department of Justice panel of prosecutors, Belo also sought the
dismissal of the charges filed against him by actress Katrina Halili
for violation of Republic Act 9262, the law on violence against
women and children.
“I have never distributed or authorized anyone
to distribute or make copies of the aforesaid videos or DVDs,”
Belo, Maria Victoria Belo Henares in real life, said in her
affidavit.
Belo said that there was no probable cause to
pin her for violation of R.A. 9262 because the important elements to
become an accessory, which are knowledge of and participation in
committing the crime, are not present in her case.
She admitted having a sex video with Kho, but
said she did not know about the other videotapes.
According to Belo, she allowed Kho to record
their sexual tryst on the agreement that after viewing the
videotape, it would be erased.
She said she broke off with Kho on December
2008, and as she was unsure if their sex video had been erased, she
sought the help of Kho’s friends Erick Chua, who is into computer
business, and Dr. Herbert “Bistek” Rosario.
But the computer, she said, was password
protected, prompting her to give her consent to Chua’s suggestion
to get the services of a computer expert to unlock it.
According to Belo, she instructed Chua to
immediately delete the sex video after they had unlocked the
password. On December 12, 2008, Chua gave Belo the DVD in the
presence of Rosario, Princess Velasco, and Jacqueline Thng, saying
“ayan regalo ko sa ‘yo [here’s my gift to you].”
Belo said she viewed the DVD when she arrived
home and was aghast to see Kho having sex with different women,
adding that out of anger she destroyed the DVD and the computer hard
drive and threw them away.
Belo disclosed that she has witnesses, which
already have executed their affidavits, who could corroborate that
she had asked Chua to retrieve the files and ordered for their
immediate disposal, and that it was Chua who first burned a DVD of
the x-rated videos from the hard drive.
Kho, in his counter-affidavit, vehemently denied
the charges hurled by Halili and the National Bureau of
Investigation against him, saying that Halili’s complaint was full
of selective and self-serving reliance on capricious and
untrustworthy narrations of others.
