The Office of the Ombudsman has ordered the dismissal of Mayor Edna Ogka-Benito of Balabagan, Lanao del Sur after she was found liable for failure to act on the leave application and payment of back salaries of an employee in 2014.
The order is immediately executory notwithstanding any motion for reconsideration or appeal, the office said.
The Ombudsman found Benito guilty of grave misconduct and also meted her the accessory penalties of cancellation of eligibility, perpetual disqualification from holding public office and forfeiture of retirement benefits.
In addition, a case for violation of Section 3(f) of the Anti-Graft and Corrupt Practices Act was filed against her before the Sandiganbayan.
Section 3(f) of the anti-graft law declares it unlawful for public officers to neglect or refuse, after due demand or request, without enough justification, to act within a reasonable time on any matter pending before them in order to obtain pecuniary or material benefit or advantage from an interested party, or to favor their own interest or to give undue advantage in favor of or discriminating against another.
