Pagdanganan opposes move to appeal case dismissal


FORMER Department of Agrarian Reform (DAR) Secretary Roberto Pagdanganan is asking the Sandiganbayan’s Second Division to deny the prosecution’s appeal on the dismissal of the graft and malversation charges against him. Last March, the anti-graft court dismissed the cases over a seven-year delay at the Office of the Ombudsman. The court granted his move to quash (void) the charges on the ground that he has been denied his right to speedy trial or speedy disposition of his case and that there is no probable cause for his indictment. But the prosecution wants the court to reconsider the dismissal of the charges saying that “[T]he delay in the completion of preliminary investigation proceedings can not result in a denial of the State’s right to prosecute if such delay was not whimsically intended to cause prejudice to the accused.” But Pagdanganan’s camp said, “The problem encountered by Ombudsman Gutierrez is a shallow justification.”
