The Supreme Court (SC) on Tuesday denied with finality the petition of the family of transgender Jeffrey “Jennifer” Laude to order the government to transfer Marine Lance Cpl. Joseph Scott Pemberton to a regular jail.
During its en banc session, the High Court ruled that there is no merit in the motion for reconsideration filed by the Laude camp.
Pemberton is detained in Camp Aguinaldo, the headquarters of the Philippine Armed Forces.
The tribunal said the Olongapo Regional Trial Court did not err when it ruled that Pemberton will remain in Camp Aguinaldo.
The Laude family had insisted that the Philippine government should have custody of US military personnel charged with murder.
The respondents in the case are Executive Secretary Paquito Ochoa, AFP chief Gregorio Pio Catapang Jr., Foreign Secretary Albert del Rosario, and Olongapo Chief Prosecutor Emilie Fe Delos Santos.
