IN the midst of the investigation on the partially unconstitutional Disbursement Acceleration Program (DAP), Palace told the Office of the Ombudsman on Tuesday that President Benigno Aquino 3rd enjoys immunity from lawsuit.
“We wish to point out the Constitutional principle that an incumbent President of the Philippines is immune from suit,” Communications Secretary Coloma told reporters.
Nevertheless, Coloma said it is within the powers of the Office of the Ombudsman to investigate Aquino and Budget Secretary Florencio Abad over the DAP.
“The Office of the Ombudsman is empowered by law to conduct such investigation,” he said.
Appearing before the Committee on Appropriations in the House of Representatives on Tuesday, Ombudsman Conchita Carpio-Morales said her office is currently evaluating a report from investigators who looked into Aquino and Abad’s possible liability for creating and implementing the DAP.
Meanwhile, Abad, who is facing plunder charges over the controversial economic stimulus program, did not comment on the Ombudsman’s investigation.
“It is prudent to read the transcript of the hearing before making any statement,” Abad said in a text message.
The Supreme Court unanimously struck down unconstitutional provisions of DAP in 2014.
