A Quezon City prosecutor has dismissed the appeal of actor Cesar Montano seeking to reverse an earlier resolution recommending the filing of charges for violation of Republic Act 9262 (Anti-Violence Against Women and their Children Act) against him. “The instant motion for reconsideration is denied for lack of merit. The resolution of this office dated Dec. 29, 2014 is hereby affirmed in toto,” said Chief Prosecutor Donald Lee, in his two-page resolution junking the motion for reconsideration filed by Montano, Cesar Manhilot in real life. The actor was charged with three counts of violation of Section 5, causing physical harm to the woman or her child of RA 9262, for allegedly inflicting physical harm on his estranged actress wife Sunshine Cruz in three separate occasions in 2009 and 2013. The case is now pending before Regional Trial Court Branch 78 Judge Fernando Sagun in Quezon City. Lee explained in his resolution that in re-evaluating the present charge, he entertains no doubt that Montano was properly indicted for his alleged acts of violence on his wife.
