Prosecutor junks perjury case filed by tulfo vs QC policeman


The Quezon City Prosecutor’s Office on Tuesday dismissed a perjury case filed by broadcast journalist Erwin Tulfo against a Quezon City policeman for lack of probable cause. Tulfo claimed that Senior Police Officer 3 Abubakhar Maglangit made false statements in a libel complaint he filed in January 2012 against him and his brother Raffy for featuring him in their TV program as a misfit and erring police officer. The libel case was dismissed by Regional Trial Court Judge Eleuterio Bathan. In filing the case, Tulfo said the statements of Maglangit, which were the basis for the charge of libel, were contrary to contents of transcript of their show episode aired on November 9, 2011. Assistant City Prosecutor Edilu Hayag, however, found Tulfo’s complaint insufficient to charge Maglangit with perjury. “There is a grain of truth in respondent’s claim as in fact his statement[s][arte]corroborated by witnesses. Thus, complainant failed to establish the essential element of perjury, that is, that respondent made a deliberate assertion of falsehood in his complaint-affidavit,” Hayag said in the three-page resolution.
