The Sandiganbayan stood pat on its ruling denying bail to former Philippine National Police (PNP) chief Avelino Razon Jr. and former Police Directors Geary Barias and Eliseo Dela Paz charged with malversation in connection with the alleged ghost repair of light armored vehicles worth P400 million.
The respondents are detained in the Philippine National Police (PNP) Custodial Center in Camp Crame.
The court, through a decision penned by Associate Justice Alex Quiroz, said the prosecution was able to establish strong evidence of guilt on the part of the accused. Associate Justice Jose Hernandez, who leads the Fourth Division, and Associate Justice Napoleon Inoturan concurred with the decision.
The court thumbed down the motions for reconsideration filed by Razon and Barias, and the the omnibus motion of Dela Paz.
Likewise denied were the separate appeals of Chief Inspector Annalee Forro, Supt. Reuel Labrado, Supt. Josefina Dumanew; non-uniformed personnel Alex Barrameda, Nancy Basallo, Patricia Enaje and Maria Teresa Narcise, and; contractors Tyrone Ong, Oscar Madamba, Pamela Pensotes and Evangeline Bais.
The court also denied the motion for partial reconsideration of Supt. Emmanuel Ojeda.
“At this point, accused-movants cannot claim that they ‘had been merely negligent’ or that they had only signed certain documents. These are already defenses which must be resolved during trial,” it said.
The court however allowed Deputy Director General Reynaldo Varilla and Director Charlemagne Alejandrino to each post P200,000 bail.
