Sandigan finds probable cause in case against aviation agency official



The Sandiganbayan has ordered a warrant of arrest issued against a Civil Aviation Authority of the Philippines (CAAP) official after the court found probable cause in the graft charges he faces.

The court found probable cause in the case of Daniel Dimagiba, former deputy director general for operations, who is facing criminal cases before the Sandiganbayan First Division.

The Office of the Ombudsman said Dimagiba allowed the issuance of an air carrier operating certificate to One Sky Aviation Services Inc. (Osasi) despite the lack of a valid certificate of public convenience and necessity from the Civil Aviation Board.

He also allegedly pressured two flight inspectors to reverse a failing mark given to two pilots whom they observed.

“After personally perusing the information and evaluating the resolution of the prosecutor, the evidence in support thereof and the records of the preliminary investigation . . . it appears that sufficient grounds exist for the finding of probable cause,” the court order, signed by Associate Justices Efren de la Cruz, Rodolfo Ponferrada and Rafael Lagos, read.

The court also issued a hold departure order against Dimagiba.

Dimagiba asked the court to suspend the proceeding against him to give him a chance to file a motion for reconsideration before the Ombudsman.
