The Supreme Court on Thursday was asked by the PDP Laban, the political party of President Rodrigo Duterte, to void the Commission on Elections (Comelec) resolution extending the deadline for the filing of the Statement of Contributions and Expenditures (SOCE) for the May 2016 polls.
In a 25-page petition for certiorari, the PDP-Laban, represented by incoming Speaker Pantaleon Alvarez and lawyer George Erwin Garcia, accused the Comelec of grave abuse of discretion by granting the extension to the Liberal Party.
“Consequently, it is now imperative for this Honorable Supreme Court to intervene in this case, issue the extraordinary writ of certiorari, and declare the nullification and setting aside of the assailed Resolution No. 10147 for being Illegal, Void,” the party said.
The original deadline for the filing of SOCE was on June 8 but the poll body granted the LP’s petition for extension, allowing it to file until June 30.
The petition was the second to be filed at the SC questioning the Comelec ruling on the filing of SOCE.
The tribunal dismissed the first petition filed by Manuelito Luna and 1-Abilidad Party-list and the People’s Freedom Party for their failure to attach a duplicate original or certified true copy of the assailed Comelec resolution.
