SC asks Court of Appeals to hear case vs. Vizcaya mining


THE Supreme Court has ordered the Court of Appeals to litigate the petition against FCF Minerals Corp. operating in Nueva Vizcaya.

A two-page resolution signed by SC en banc clerk of court Atty. Enriqueta Vidal during the hearing on November 12, 2013, stated: “In accordance with the resolution dated October 17, 2013, the court resolved to note and refer to the Court of Appeals, for appropriate action.”

The Court has just issued a writ of kalikasan against FCF Minerals Corp. on October 17.

A writ of kalikasan is a remedy under the 2010 Rules of Procedure for Environmental Cases that seeks protection of one’s constitutional right to a balanced and healthful ecology.

Dolphy Tindaan, Teresa Tindaan, Oscar Banih and Ziga Gayana, both of Runruno Land Owners’ Association, Barangay Runruno, Quezon, Nueva Vizcaya, are among the petitioners.

They filed the petition citing, among others, a number of cases of ecological destruction, resource plunder and poisoning.
