SC junks criminal raps vs BIR regional director


The Supreme Court has dismissed the charges against a Regional Director of the Bureau of Internal Revenue (BIR) in connection with his alleged failure to disclose in his sworn Statement of Assets and Liabilities and Net worth for 2002. In a decision penned by Associate Justice Diosdado Peralta, the High Tribunal’s Third Division granted the petition for certiorari filed by Danilo Duncano as it reversed the August 18, 2009 resolution and February 8, 2010 order of the Sandiganbayan Second Division, which denied petitioner’s motion to dismiss on the ground of lack of jurisdiction.
