THE Supreme Court (SC) has junked a petition of Sen. Juan Ponce Enrile seeking to stop his preventive suspension as senator of the Republic.
It ruled to dismiss his petition for being moot and academic because the Sandiganbayan has already implemented the suspension order against him.
In the meantime, the SC has decided to rule on a petition for certiorari filed by Enrile for his bail and on a petition for certiorari on denial of the Sandiganbayan of his plea for “Bill of Particulars”on April 25 during its summer session in Baguio City.
The senator is asking to stop the Sandiganbayan from proceeding with the trial of plunder and graft charges filed against him for his alleged involvement in the P10-billion pork barrel fund scam.
In his 73-page petition for certiorari, Enrile, through his lawyer Estelito Mendoza, asked the High Court to issue a temporary restraining order or a writ of preliminary injunction, which would stop the Sandiganbayan from proceeding with his case.
Enrile elevated his case before the SC against the Sandiganbayan 3rd Division for committing grave abuse of discretion amounting to lack or excess of jurisdiction.
He also asked the tribunal to expedite resolution of his petition and to set the same for oral arguments.
