SC justices uncowed by Pnoy ‘threats’

Justices of the Supreme Court (SC) will continue to protect “government funds” and the “interest of the Filipino people” even under “threat” from President Benigno Aquino 3rd to possibly remove them through impeachment in retaliation for their failure to defend the Disbursement Acceleration Program (DAP).

The Manila Times learned over the weekend that the magistrates’ display of apparent grace under pressure was what has infuriated the President since the SC justices a few weeks ago declared the DAP unconstitutional mainly over its cross-border transfer of funds.

An unimpeachable source on Sunday said Aquino was particularly mad at his four appointees—Chief Justice Maria Lourdes Aranal-Sereno and Associate Justices Bienvenido Reyes, Estela Perlas-Bernabe and Marvic Leonen—who made possible the unanimous 13-0 vote that found illegal the Malacanang-implemented DAP.

Associate Justice Teresita Leonardo-de Castro inhibited herself while Associate Justice Roberto Abad retired in May this year.


According to The Manila Times source in the High Court, the 14 justices had received reliable information that the President is so mad at them, again in particular at Sereno, Reyes, Bernabe and Leonen for concurring with the DAP ponencia of Associate Justice Lucas Bersamin.

“Galit si Pnoy sa apat niyang appointees kasi kahit isa sa kanila walang nag-dissent dun sa DAP para ipagtanggol siya. Biruin mo nga naman ang boto 13-0 [Pnoy {short for President Noynoy} is angry with his four appointees because not one of them dissented with the ruling in order to defend him. Just imagine the 13-0 vote],” the source said.

The Aquino appointees, according to The Times source, simply cannot make a winning case for the DAP.

Calling the four appointees by their nicknames, the source said, “Hirap sina Meilou [Sereno], Telie [Bernabe], Marvic [Leonen] at Bodgi [Reyes] na ipagtanggol ang DAP, kasi tagilid talaga yung kaso lalo na pagdating sa isyu ng cross-border [Sereno, Bernabe, Leonen and Reyes found it hard to defend the DAP, because the case was on shaky ground especially on the issue of the cross-border transfer of funds].”

Another source said, “Napansin ng mga justices. Iba talaga takbo ng utak ni Pnoy. Pag nasabi, nasabi kahit mali. Spoiled brat kasi [The justices noticed. The President thinks differently. He insists on what he says. Even if it is wrong. He is a spoiled brat]. “

The SC justices, it was also learned, will continue to do their job despite the “threats” made against them by Aquino in a few public speeches scoring them for declaring the DAP unconstitutional.

The unimpeachable source said the “third party” mentioned by the President in a speech could be the legislative, which has primary mandate on impeachment cases.

The source added that the SC is “solid” right now and its justices are not cowed by who put them there.

When Aquino delivers his fifth State of the Nation (SONA) today before a joint session of Congress, the magistrates expect “mudslinging” from him, although SC justices are usually not invited when the President delivers the SONA.

Only the Chief Justice gets to hear the SONA right inside Congress.

Lawyer Theodore Te, SC spokesman, on Sunday said Sereno will attend today’s joint session.

    The SC has no choice but to apply only the visual or written test. Ordinary mortals can also apply the smell and taste test.

  2. The SC justices appointed by the INCOMPETENT occupant in Malacanang should not feel obligated to him just because he appointed them. They are paid by the government money and not by him so their loyalty is to the country and not to that INCOMPETENT animal!!!

  4. The president of the philippines needs to understand that in a democratic coutry appointees wont side with their friends they will side with whats right. If the president doesnt understand that then he needs to be taken out of office. Anyone can get things wrong. No one is infallible. Someone has to be in the supreme court & all of those someone’s i would hope would uphold the rule of law & what is right & not on who put them in their position.

    The people fully supports the Supreme Court justices on their DAP decision declaring it unconstitutional. In the present Motion for Reconsideration filed by Aquino and Abad, the Supreme Court should require the movants to submit a detailed accounting and use of the DAP funds which is determinative of whether the money was actually utilized in good faith for the public good. If it turns out that part of the funds was exorbitantly paid to the aquino-cojuangco clan for the hacienda luisita, that will disprove good faith and public good being claimed by aquino and abad, one reason, among others, to deny the motion filed by aquino and abad to reverse the finding that the DAP is unconstitutional.

    . . Kung dictatorial government ang sitwasyon, pwede yong DAP, ganon lang kasimple. Eh,ang laki na ng perang nasangkot sa programang ginawa, kaya idine-depensa pa rin, na kahit umabot na sa parang istilong away – palengke. Idaan sa legal na paraan at di dumadaldal kung saan-saan. Sa ginawa nila, bukod sa unconstitutional may discriminasyon pa, kung sinong malapit sa kusina,busog na busog (sa project) .’pano naman ang iba?.

  7. These SC justices, especially, the four appointees of PNoy now know dealing with a madman’s whims need sane decision. To be sure, their legacy in public service is more important than loyalty to the appointing party whose term might not even reach 2016.

  8. pinalabas lang ni pnoy na kapag hindi niya nakuha ang gusto niya, maguupo sa sahit at magdadabog na may patadyak tadyak pa while at the same time nagiiyakiyakan kuno. kaya siguro walang babae na nagtagal sa kanya eh. gusto niya laging sa kanya ang attention.

We are a grateful nation and we laud our supreme court justices for taking our side against the mentally deficient temporary occupant at Malacanang who insist on doing what he fancies even if it is wrong and unconstitutional.

    The nobility of the supreme court justices is not lost on us. We also stand behind them against their crisis with this abnoy.
