• SC orders refund of wrongly paid docket fees


    THE Supreme Court (SC) has approved a request of lawyer for refund of over P94,000 in filing fees that he erroneously paid to the Office of the Clerk of Court and Ex-Officio Sheriff of the Regional Trial Court (RTC) of Urdaneta City, Pangasinan, in 2013. In a full-court ruling, promulgated by Clerk of Court Felipa Anama, the 15-man tribunal granted lawyer Joel Romero’s request for the refund of the docket fees paid by a mortgagee-bank to the RTC, which did not have jurisdiction over a subject parcel of land in a petition for extra-judicial foreclosure. In its ruling, the SC held that it is undisputed that the subject filing fees were paid to RTC-OCC Urdaneta owing to a mistake of fact that it had jurisdiction over the subject land located in Malasiqui, Pangasinan. “The ground upon which the right of recovery rests is that money paid through misapprehension of facts belongs in equity and in good conscience to the person who paid it,” the High Court said.
