The Supreme Court has dismissed the complaint against a retired judge in Lucena City, Quezon, charging him for allegedly failing to take action of several civil cases pending in his court.
In an en banc decision, the Court absolved Judge Guillermo Andaya, formerly of the Regional Trial Court (RTC), Branch 53, in Lucena.
Andaya faced an administrative complaint for gross incompetence, inefficiency, negligence and dereliction of duty filed through the Office of the Court Administrator (OCA).
The complaint alleged that Andaya sat on certain cases before his sala.
The complaint was filed on April 29, 2009 less than a month after the judge retired on March 27. The Supreme Court held that for it to acquire jurisdiction over an administrative case, “the complaint must be filed during the incumbency of the respondent.”
