TAYABAS CITY, Quezon: The Department of the Interior and Local Government in Calabarzon region on Friday served the suspension of Tayabas City Mayor Faustino “Dondi” Silang as ordered by the Deputy Ombudsman for Luzon dated July 11, 2014.
Silang and Councilors Rex Aba–dilla and Macario Reyes were suspended for six months for violation of Sections 4 and 7 of Republic Act 6713 (Grave Abuse of Authority) filed by the Councilors Rosauro Dalida, Nicodemes Abesamis, Catalino Cabriga and Maria Lourdes A. Reynoso.
The case stemmed from the hiring of Atty. Jose Augusto Salvacion as city legal officer while practicing as a private lawyer, which violates Republic Act No. 7160 otherwise known as the Local Government Code that states “all cities should appoint a city legal officer to protect and promote its legal interest, and contrary to jurisprudence that prohibits local governments from seeking legal representation from private counsel”.
Prior to the implementation of the suspension, Silang’s camp filed a motion for reconsideration at the Office of the Deputy Ombudsman for Luzon but it was junked through the 13-page resolution dated July 11, 2014 signed by Ryan Hartzell C. Balisacan, Graft Investigation and Prosecution Officer I and Bayani Jacinto, Graft Investigation and Prosecution Officer III.
The said resolution ordered the suspension of Tayabas Mayor Faustino Silang, Vice Mayor Luzviminda Cuadra and city councilors Venerando Rea, Rex Abadilla, Abelardo Abrigo Jr., Macario J. Reyes, Roy Librado Oabel and SP member Romero Cayanan.
DILG Regional Director Josefina Castilla-Go sent his assistant regional director, Ariel Iglesia to implement the suspension, assisted by DILG provincial Director Eric Damot and she specifically told them to explain the “staggard” suspension they have to adopt. Abrigo will be suspended on September 20.
Presently suspended were Cuadra and Rea and their suspension end on Sept. 19. She said they have to adopt the staggard suspension to not to create a vacuum in the city council because almost all of the incumbent councillors are included in the suspension. Cuadra is the incumbent vice-mayor and she is currently replaced by Councilor Wenda Saberola.
