Supreme Court (SC) justices were unfazed by President Benigno Aquino 3rd’s tirades against the tribunal’s ruling on the Disbursement Acceleration Program (DAP) as they vowed to uphold “the rule of law,” not “the rule of men.”

The SC did not issue a statement on the President’s speech on Monday night that challenged the High Court’s ruling on the DAP, but sources at the tribunal on Tuesday said the justices believe that their unanimous decision declaring the spending program unconstitutional is right.

SC spokesman Theodore Te told reporters that the “SC has no comment on the President’s speech yesterday [Monday].”

But sources told The Manila Times that the justices discussed Aquino’s attack on the SC during their en banc deliberations on Tuesday. The magistrates vowed to perform their mandate “against all odds” because they believe that they have done nothing wrong, the sources said.

“The court will do its job and wait for the motion for reconsideration,” one source told The Times. “They will let the rule of law prevail, not the rule of men,” he added.

In their deliberations on Tuesday, the justices were one in saying that they will not be moved by the President’s threats because through their DAP ruling, the SC was able to protect government funds and the interest of the people, the source said.

In his speech defending the DAP on Monday, Aquino warned of a collision between the executive and the judiciary, saying a “third party” may have to intervene if such a clash occurs.

The source said the SC is “solid” in its DAP ruling and that the justices will not be swayed in their stand even if some of the members of the court were appointed by Aquino.

Four of the SC justices are Aquino appointees—Chief Justice Maria Lourdes Sereno, Bienvenido Reyes, Estela Perlas Bernabe and Marvic Leonen. The remaining 10 justices were appointees of former President Gloria Macapagal-Arroyo—Senior Associate Justice Antonio Carpio, Justices Presbitero Velasco, Teresita Leonardo-de Castro, Arturo Brion, Diosdado Peralta, Lucas Bersamin, Mariano del Castillo, Martin Villarama, Jose Perez and Jose Mendoza.

“Mas solid ang Supreme Court ngayon [The SC is more solid now],” the source told The Times.

“There are no more Arroyo or Aquino appointees. It is the institution, the Supreme Court, which must be protected,” the source said.

He added that the magistrates vowed to act “as magistrates” when the government will file its motion for reconsideration.

But former senator Joker Arroyo said the President “practically declared a state of war with the High Court.”

The former lawmaker, the Executive Secretary of the late former President Corazon Aquino, said the President is out to discredit the judiciary.

“As the picture looks presently, the President’s policy is to discredit the judiciary and render it impotent, subjugate Congress and make the President supreme. Yet by his oath of Office, the President is duty-bound to preserve and defend the Constitution,” Arroyo added.

He noted that before Aquino addressed the nation on Monday, “the administration took pains to establish a massive encirclement attack on High Court.”

“Congress has threatened to eliminate the Judicial Development Fund [JDF] of the Supreme Court to impair its constitutionally guaranteed fiscal autonomy. The COA [Commission on Audit] has published the individual Justices’ earnings to embarrass them. The BIR [Bureau of Internal Revenue] has recently issued a Memo Order designed to tax a hitherto untaxable additional income of employees of the judiciary from JDF,” Arroyo explained.

He said the President, in challenging the SC ruling on the DAP, also questioned the justices’ “collective capacity and integrity.” That stance of the President, Arroyo
added, “undermines the Supreme Court.”

Sen. Juan Edgardo Angara doubted that the SC will reverse its ruling on the DAP.

“President Aquino has been always passionate in his positions. But I will be surprised if the Supreme Court will reverse its decision, considering that it was unanimously signed,” he told reporters also on Tuesday.

“I support the President when he was executing and distributing the DAP, but now, I have changed that position, after the SC handed down its ruling,” the senator said.

If we allow these things to affect us and another president is jailed, won’t it show that we are a very stupid nation to vote for criminals 3 terms in a row? In the future, nobody will want to run for the presidency if they risk being jailed when their term is about to end.

  2. the president said that they merely used the savings of non-functioning offices so that they can use it for projects and the creation of DAP was for noble purposes daw.. but despite noble intentions he is not above the law.. he has sworn to protect the constitution he now condemns for declaring his DAP illegal.. the end does not justify the means. para naman syang batang nagtatantrums dahil lang sa hindi nabigay yung gusto nya.. Grow Up Mr. President..

  3. Everybody knows what is Justice. The Supreme Court rules in accordance with what is provided in the law. Ignorance of the law excuses no one. In any place, if people follow the laws then the law as written is useless therefore the law is being made for people who does not follow the law. The President is subject to that law, with his being president insisting that his DAP is in good faith inspite of the ruling of the highest court that it is unconstitutional. then people should act to remove the president and transfer him to lead the communist party as his idea would suit on the rules of the Kangaroo Court.

His trust of targeting the Chief Justice first, then followed by J.P.Enrile, then, Revilla, Estrada and others waiting to be incarcerated, never before in our history before P.Aquino has done this. We have seen all this unbelievable trend in the News and Television. Let us be patient and watch how our president will stop the cycle of corruption in our country. The late Senator Recto once observed:”There is no difference between the nationalista from the liberal party, except that one is like a Fat Mosquito and the other a Thin one.” Let us not be distracted to follow the incarceration of the suspected CROOK. By focusing on the so-called legal or illegal acts of our president. Let our president and his team try what is good for our country.
    While it is true that Supreme Court interprets the laws. Let me quote as a lawyer what I learned:”The rules and principles of CASE LAW has never been treated as FINAL TRUTH but simply working hypothesis being tested and retested, and in that process of testing and retesting, there is that constant rejection of the dross and constant retention of what is pure,good and fine.” Our country needs a practical approach which can be within our legal system, after all the Law as we know it is highly subjective and like a coin has its two sides.

Even if the trolls keeps on repeating their often hated remarks and still applied it to what happened to their losing DAP saying ‘even the Supreme Court legalized martial law’, what they forgot was that the Supreme Court, whether right or wrong, will always be the final interpreter of the law.

    Even if this president will always say that he has not been given the flexibility to do an executive job, the Supreme Court must always be blind and uphold the law. What this president should have done is to work for the amendments to the Constitution. Kung nagmamadali siya, hindi niya call yun. Tutal, he holds the Congress in his hands. Why not instruct his tutas to amend and pass laws to his liking? or call a referendum? d ba , he claims he is still popular?

  9. Reading at different opinions on the crazy and slipshod behavior of Pres. Aquino is both annoying and funny. But the funniest and empty comments is that coming from JT. Reminding me of the Chinese proverbs -” maraming salita, maraming mali, kunting salita kunting mali; walang salita walang mali (too much talks, plenty of mistakes; little talk, little mistake; no talk no mistake). There is only one basic tenets in arguments, and that is – Aquino brainlessly committed a blatant and culpable violation of the Constitution, period. Butch Abad merely did as instructed by Aquino to do what is not allowed by law. As a lawyer, he should have not prostituted his principles (if he has any left in his ass) by agreeing to the stupid instruction of his boss. Now, the die is cast. The SC have spoken that the DAP is unconstitutional – in short illegal. What else do you all guys want to say? It’s so simple to discern – Aquino did the unthinkable. Aquino’s position now is truly indefensible – so there’s no need for you guys to come to his aid and defend the indefensible. The President is busy right now squeezing the neck of his perceived political enemies while poor Juan de la Cruz could hardly find his next meal. I have seen the pains and pangs of abject poverty, the bare-footed poorest of the poor, and the worst disadvantaged of our countrymen in the far-flung corners of different barangays. Where are the politicians? What have PNoy done for 4 years of his administration to bridge the gap between the poor and the rich? NOTHING. Practically nothing!!!

  10. Mukhang marami ng naniniwala na may ngipin ang batas or hindi lang nila nauunawaan ang sitwasyon. When I watched the speech of Pres. Aquino depending the DAP, I became impressed to Mr. Abad. Grabe ang galing nya and wala akong nakitang mali how the Administration change the process on budgeting. Siguro hindi ito yung usual, conventional or nakasanayang gawin kaya sinasabi nila na mali. Pero yung effectivity, I say ang galing. Siguro kailangan ng bawat Pilipino na maging open for changes lalo na para sa kabutihan ng ating bansa. Kalimutan na yung mga konserbatibong pamamaraan na nagpapabagal sa ating pag-unlad at pagyamanin naman yung mga konserbatibong pamamaraan na epektibo. Para sa SC, sana malinis rin ang institusyon na ito. Sabi nga ng nakararami eh ang kurapsyon sa Pilipinas ay nasa lahat ng sangay. Alam ng bawat Pilipino na maraming controversial ruling na ginawa ang SC, isa na dyan yung kay Mr. Hubert. Kaya, let us always be vigilant and examine our core values.

    It is the height of the President’s stubbornness not to accept that he is indeed wrong on DAP and now he is acting like a dictator challenging the Supreme Court that the Justices were wrong on their decision.

    Pnoys reliance on Sec. 39 of the Administrative Code is legally misplaced! The spin doctors of malacanang does not even know how to play their game in a consistent manner. solicitor gen. Jardaleza argued that DAP is based on Sec 38 re impoundment . SC said DAP is not impoundment. But pnoy now says they relied on sec. 39. He he he, they cant get their act together.

Threats, bribes, and other illegal acts the President uses to get it done his way does not speak well for him. He should follow my example and admit a mistake.   23. Our officials shall be careful on their rethorics. Use of “declaring war on SC” is irresponsible statement from a previous Senator. It is clear what the President said in his address on DAP in Pilipino. That the programs by government are good for the common people and that SC should reconsider its ruling on DAP. The President further stated that there were similar programs like DAP in previous administrations.

    Given the DAP programs have already been committed and some already expended, I believe the President challenge in court ruling is legitimate. In this scenario there will be third branch of government that will break the impasse.
    I also believe that some justices in SC are playing politics.

      What the SC declared as unconstitutional are the acts of the Executive branch in implementing the DAP

      Sure, some the DAP projects benefited the people

      And, as as republic, we have a constitution and laws to follow and uphold.

      And, the President swore to protect and uphold the constitution

      The President cannot say that the end justify the means

      It is incumbent therefore that the President must accept and respect the decision of the SC on the DAP

      After all, we need to have the rule of law

    • What exactly has the King PNoy DAP done to benefit the ordinary citizen of this country. do you have the audited statement of each claim in the list? Do you have the individual names or titles of the project, where they are, how much each costs the government, are these projects finished, half finished, 1/4th finished? Or did you just take PNoys word that there are projects named, approved or ongoing therefore the DAP helped the economy. Maybe you need to be informed that the World Bank wrote in its report that the DAP contributed less than 1%, repeat, ONE PERCENT of the supposedly successful program of the PNoy administration. Or maybe you want to ask the World Bank yourself.

  25. Even an ordinary High School student knows that in King PNoy’s speech he threatened the Supreme Court to change their decision. Now his allies are starting to pressure the Court and it’s members with an assortment of issues. This is one of the only things PNoy knows, to use his power of corruption and bribes. Just like his being an architect of the DAP, his technique is way too obvious to the public. PNoy really has no brains. He does not know how to deal with the SC, now he is an enemy of the Supreme Court as an institution and the Justices personally. Let us support the Supreme Court from the monster sitting in his throne in Malakanyang.

  26. Uphold “the rule of law,” not “the rule of men.”
    We must remember the rule of laws were made by men, therefore the rule of law is the rule of men, too.
    If those who makes the law have biases, self interest and cultural/religious motivated, the law becomes unfair, obsolete and subject to criticism (imperfect).

    • I agree with you that laws are not perfect, as they are merely products of the human mind – which is likewise prone to fault. But at the very least laws exist to exert consistency and order in the society.

      So when we say rule of law I believe it pertains more to equal application of the laws. Whereas as for the rule of men, it refers to the arbitrariness of the application of the same.

      Besides, if everyone questions laws without having the SC invalidate them, then I doubt we’d have order in this Country as everyone will have their own interpretation – or way of disregarding – such laws.

      Just my two cents. :)

    In this country where we have now a madman who no longer have any respect of
    the law, it becomes the responsibility of every Filipino to exercise and use their
    guts if only to restore the dignity and respect to this country. For there was no
    administration and no president in the past has ever started a fight with the
    Supreme Court. The constitution says, congress will enact the law, the executive
    will implement the law and finally it is the Supreme Court who will interprete the
    laws. As in the case of the DAP, the Supreme Court already had faithfully interpreted
    the law and had rendered their decision accordingly. But this president, who has
    the temerity to go against it now declare an assault against the Supreme Court which
    tantamount to a constitutional crisis. This is very dangerous. As a Filipino, I am
    deeply concerned about this situation. It now becomes the responsibility of every
    peace loving Filipino to show their guts to protect this country.

    Pres. Pnoy has the duty to defend, respect and abide by the Constitution. He set a VERY BAD EXAMPLE BY OPPOSING AND CHALLENGING THE DECISION THAT DAP IS UNCONSTITUTIONAL. THE PROCESS IS ILLEGAL REGARDLESS OF THE INTENSION OF DAP. PNOY MUST RESPECT THE UNCONSTITUTIONALITY OF DAP.

    PNOY MUST APOLOGIZE FOR SETTING A VERY BAD EXAMPLE TO ALL … LEGISLATORS AND THE FILIPINO PEOPLE.

    WHO ARE YOU MR. PRESIDENT? A dictator? A Robin Hood? Robbing Hood? Where did the DAP money go? Who received the DAP funds?

    There is nothing wrong of what the President has done. What the judicial branch of government must be doing is to prosecute those politicians who are CROOKS!
