Three justices of the Court of Appeals (CA) First Division have signed the order granting the petition for the issuance of a writ of habeas corpus filed by the camp of Globe Asiatique founder Delfin Lee.
The writ of habeas corpus was signed by Associate Justices Manuel Barrios, Stephen Cruz and Normandie Pizarro.
Any time from now, it is expected that the formal order will be issued.
In the signed writ of habeas corpus by the members of the CA First Division, it ordered the Philippine National Police (PNP) and National Bureau of Investigation (NBI) to physically bring Lee to the CA on Wednesday morning.
The writ issued by the CA was directed to the arresting officers of Lee and those who took him into custody to explain the legality of his detention.
In the petition filed by the legal counsel of Lee before the CA on Monday, it asked for the release from detention of the controversial businessman.
It argued that the arrest made on Lee was allegedly illegal, because the CA has already ordered the lifting of the warrant of arrest issued by the San Fernando City, Pampanga Regional Trial Court (RTC) against Lee.
The arrest warrant was in connection with the P6.6-billion syndicated estafa case filed against Lee for allegedly using “ghost borrowers” to obtain housing loans from Pag-IBIG Fund and the “double sale” of real estate properties.
Under the Revised Rules of Court, the writ of habeas corpus is issued in cases of illegal confinement or illegal detention. PNA
