Napoles asks Sandiganbayan to dismiss case

THE defense counsels of convicted businesswoman Janet Lim Napoles have asked the Sandiganbayan to dismiss the charges against their client, saying that the prosecution’s five-year failure to provide convincing evidence in the void plunder charge merits dismissal of the charges. In an urgent ex parte motion, Napoles’ counsels, led by lawyer Rony Garay, said the continued charges violates the constitutional rights of their client as there is no longer a central “main plunderer” as required by the jurisprudence on the plunder law, a state of affairs which has turned the charge against Napoles into a “void information.” The counsels added that at stake is their client’s right to due process and right to be presumed innocent. The next scheduled hearing of the case is on September 9.
