Baldo posts P8.7-M bail

LEGAZPI CITY: Former Daraga mayor Carlwyn “Awin” Baldo, tagged as the mastermind in the killing of Ako Bicol party-list Rep. Rodel Batocabe last year, posted P8.7-million bail on Wednesday for his temporary liberty.

Baldo’s lawyer, Merito Lovensky Fernandez, and mother Gloria Go-Baldo, assisted in the posting of bail.

Last week, Judge Maria Theresa San Juan Loquillano of the Legazpi City Regional Trial Court (RTC) Branch 10 granted Baldo’s petition for bail, saying the prosecution did not present strong evidence against the former mayor.

Baldo’s mother refused to give a statement.

Baldo was charged with two counts of murder for the killing of Batocabe and his police escort, Senior Police Officer 4 Orlando Diaz, on Dec. 22, 2018.

Justine Batocabe, son of the slain lawmaker, said they might file a case against the judge for grave abuse of discretion.

“He is not yet totally free. His bail now only grants him temporary liberty. We must still see him in court,” Justin said in a statement.

“We will study whether we can hold the judge accountable for grave abuse of discretion or overstepping the limits of her authority,” he added.
Justine said his family remains in “grief, shock, anger and disbelief.”

“Our only consolation at this point [is] that the charges against Carlwyn Baldo remain pending and alive, and that Baldo is no longer mayor of Daraga,” he added.

Ako Bicol lawmakers and Batocabe’s family had said they would file a motion for reconsideration.

“We have forwarded to the prosecutors our motion, they will be the one to actually file since it’s a criminal case,” Justin, a lawyer, said.

Among the members of the House of Representatives who opposed Baldo’s temporary release were Deputy Speakers Vilma Santos, Dante Markoleta and several other lawmakers.
