THE Manila Regional Trial Court (RTC) Branch 15 on Wednesday convicted eight Philippine Coast Guard (PCG) personnel of homicide for the killing of a Taiwanese fisherman in Batanes in May 2013.
Manila RTC-15 Judge Eduardo Ramon Reyes convicted Cdr. Arnold dela Cruz, SN2 Nicky Aurelio, PO2 Richard Fernandez Corpuz; and Seamen 1st Class Nicky Reynaldo Aurelio, Edrando Aguila, Mhelvyn Aguilar Bendo 2nd, Andy Gibb Golfo, Sunny Galang Masangkay and Henry Solomon.
The accused were sentenced to imprisonment of 8 years and 1 month to 14 years, 8 months and a day with payment of P50,000 in civil indemnity and P50,000 in moral damages for the death of Hong Shi Cheng on board the Guang Da Xing No. 28.
“With the accused conspiring, with intent to kill, killed victim Hong Shi Cheng with no legal justification duly proven, the moral certainty that produces conviction of the accused for homicide in an unprejudiced mind has been satisfied,” the ruling read.
The chase happened on May 9, 2013 in Balintang Channel with the PCG firing at the fishing vessel, resulting in the death of Cheng. While at the entrance of the ship’s engine room, he received a shot that went though his lower left neck.
The fatal shot caused a rapture in the upper lobe of his lungs, which led to a massive bleeding, the ruling added.
“The court manifested that [the accused] be allowed provisional liberty under their bonds,” a court personnel said.
