Builder in bad faith disentitled to reimbursement

Dear PAO,

I demanded from Ruben to stop the construction of his building because the same was encroaching in my land. The latter replied and claimed that he built the structure within his land, which is covered by a Torrens Title. A demand letter was sent to him to demolish the structure and, there, I attached the relocation survey approved by the concerned government agency to prove my claim. Ruben replied, demanding reimbursement for the construction of his building. Is he entitled to his claim?
