The Constitutional prescription under Section 11, Article XII limiting foreign investment/equity participation in public utilities to no more than 40 percent is implemented in conjunction with Commonwealth Act 146, otherwise known as the “Public Service Act (PSA),” which identifies those who are considered engaged in “public service.”
